These Terms of Service govern your use of the PureView Private Care Management website, including our resource library, assessment tool, and contact forms. By using this site, you agree to these terms. If you engage PureView as a client, your services will be governed by a separate written service agreement; if that agreement conflicts with these terms, the service agreement controls for the services it covers.

PureView provides care coordination, advocacy, and navigation services. We do not provide medical advice, diagnosis, or medical treatment, and nothing on this website is medical advice. Our guides, articles, and assessment results are general educational information. They are not a substitute for the judgment of a physician or other licensed medical professional who knows your family member's situation. Always consult a qualified provider about medical decisions, and call 911 in an emergency.

Although members of our team hold professional licenses and certifications, including registered nurse licensure, PureView does not practice nursing or medicine through this website or through its care management services. Our team's credentials inform the quality of our coordination and advocacy; they do not create a nurse and patient or provider and patient relationship, and no PureView service should be relied upon as a substitute for hands on medical care from your loved one's treating providers. Final decisions about care always rest with the family and the treating medical team.

Reading our resources, submitting the assessment, or contacting us does not make you a PureView client and does not create a professional, fiduciary, or provider relationship. A client relationship begins only when both parties sign a written service agreement.

Information on this site is provided to help you make more informed decisions, but you are responsible for the decisions you make. Care situations differ, laws and program rules change, and general information can never account for every circumstance. You agree that you will independently verify information that is material to your family's decisions and that you assume responsibility for actions you take or do not take based on content from this site.

The content on this site, including guides, articles, checklists, text, and graphics, belongs to PureView and is protected by copyright. You may view, download, and print materials for your family's personal, noncommercial use. You may not republish, sell, or use our content commercially without our written permission. Linking to our pages is welcome.

You agree not to misuse the site: no attempts to breach security, scrape content at scale, submit false or harmful information through our forms, or use the site in any way that violates applicable law.

To the fullest extent permitted by law, PureView will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this website or reliance on its content. Our total liability arising from use of this website will not exceed one hundred dollars ($100). Nothing in these terms limits liability that cannot be limited under law. This section applies to website use only; liability related to client services is addressed in the applicable service agreement.

This limitation applies to all theories of liability, whether contract, tort (including negligence), strict liability, or otherwise, and applies even if a remedy fails of its essential purpose. It extends to PureView Private Care Management and its owners, members, officers, employees, and contractors.

You agree to indemnify and hold harmless PureView Private Care Management and its owners, members, officers, employees, and contractors from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of this website, your violation of these terms, or content or information you submit through the site that infringes the rights of, or harms, any third party.

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any dispute arising from use of this website will be brought in the state or federal courts located in Massachusetts, and you consent to the exclusive jurisdiction and venue of those courts. Any claim arising from use of this website must be brought within one (1) year after the claim arises, or be permanently barred, to the extent permitted by law.

If any provision of these terms is found unenforceable, the remaining provisions stay in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. These terms, together with our Privacy Policy, are the entire agreement between you and PureView regarding use of this website. Our failure to enforce any provision is not a waiver of it.

We may update these terms from time to time. Changes take effect when posted, and the effective date at the top of this page will reflect the latest revision. Continued use of the site after changes take effect constitutes acceptance.
